The Ministry of Communications (Mincom) approved the Regulation for the manufacture of telecommunications equipment, devices or parts associated with these, a necessary norm that updates what is established in Decree Law 35.
Published in the Official Gazette No. 78 Ordinary, Resolution 52/2022, is applicable, among others, to the active equipment used in telephone networks, both fixed and mobile, and radio communications networks, radio control devices, prototypes and serial productions limited in nature; equipment with industrial, scientific and medical applications; and others for educational purposes linked to specialized education.
However, according to the regulations, those built by natural or legal persons for domestic or family purposes or in the exercise of amateur radio are excepted, since for the operation of this equipment, current legislation must be complied with.
The natural or legal persons interested in this process must obtain an authorization from the Mincom, through a request submitted to the Budgeted Technical Unit for the Control of the Radioelectric Spectrum, which must issue a response within a period of 30 days.
However, it is stipulated in the rule that the authorization does not grant the right to its installation and use, and its payment will be made electronically or in person for the value of 60 pesos.
The Resolution also establishes that the manufacture of telecommunications equipment must undergo the process of compatibility with the ministries of the Revolutionary Armed Forces and the Interior, and does not exempt compliance with the regulations that govern the use of the different telecommunications services and of the use of the radio spectrum, technical regulations or international standards, as well as protection measures against cybersecurity incidents.
