The crime that shocked Colombia, the murder of patrolwoman Luisa Fernanda Zuleta and his partner, the subintendent Sergio Yépez Páez, in the department of Antioquianow has a new chapter with the capture of who was its commander, Police Major Darlinton Macías Trejos, commander of the Yarumal Police Station, in the same department.
The officer was captured by order of the Military Criminal Justice and the crime is disobedience. The preliminary report obtained by SEMANA indicates that the major was aware of the orders given from the Directorate of Citizen Security of the Police Regarding the movements of the uniformed men and even so, he gave orders to his subordinates in the opposite way.
“According to the officials, the officer would have failed to comply with the order to remove the quadrant patrols jointly, failing to comply with the security protocols, a situation that would have favored the members of criminal structures to carry out the homicide of the uniformed men,” the report indicates.
According to the reports, the patrols in that area of the country had to move or be made up of at least four uniformed men, in order to guarantee the safety of the police officers. However, according to that report, the major authorized the patrol boat Zuleta and the subintendent, went out alone on the tours, which could motivate and facilitate the armed attack.
The case became several investigations: disciplinary, criminal and in the military jurisdiction, in the latter came the decision to capture the officer for the crime of disobedience. The oldest will be presented before the judges of guarantees in the Military Criminal Justice and basically it will launch the new accusatory penal system in that instance.
For that jurisdiction, it is clear that the officer in command of the rest of the uniformed did not take precautionary measures and, on the contrary, put men and women at risk at your expense. He made decisions that left the staff vulnerable, with the results that the country knew and reproached.
The Military Criminal Justice collected evidentiary material that included statements from other soldiers and the conditions of the area where the murder of the patrol car and the subintendent occurred. The result of these verifications is that basic or minimum protocols to guarantee the security of the uniformed officers were effectively omitted.
The capture of the major, commander of the Police Station in Yarumal, Antioquia, responds precisely to those analyzes carried out by the prosecutors of the Military Criminal Justice after concluding in the presumed responsibility of the officer in the crime of disobedience. A criminal conduct that is only constituted in the military jurisdiction.
The decision of the Military Criminal Justice does not affect at all the other investigations that are carried out in the Prosecutor’s Office and in the disciplinary scenario, also against the major. Although it is based on the presumption of innocence, in the military jurisdiction the matter It seems more complicated for the officer, because precisely the documents and the statements indicate that it was he who gave the order or authorized the patrol car to move along with his partner.
After the preliminary hearings, it will be known what the procedure against the officer will be, if she continues to be captured or is allowed to be released while the process against her progresses. The events, which were highly reported by the community, now leave this complicated situation for the officer.
