In Legal Affairs they consulted with the lawyer Dionisio Araújo, a partner at Archila Abogados, about what happens when these events happen, because many times, these establishments offer excuses, but they do not help pay for the damages.
According to the jurist, “any clause that they impose to exonerate themselves from responsibility is null. They have the duty to respond for the care of the vehicle and, if something happens, there has to be a mechanism to claim”.
In fact, everything that has to do with the care of the vehicle must be consigned clearly and very visible. On some occasions, the parking lots choose to put it on the exits or entrances and on other occasions on the entry and exit tickets in which the time of entry and the license plate of the vehicle are marked.

Just as in many places they make it clear that they are not responsible for the objects that are left inside the cars, they must also have the same visibility of what would happen in the event of a crash inside the parking lot. Even about the items that are left inside the vehicles, says the lawyer, the establishments “must say how to register it and leave it in custody and what to do if something happens.”

The entity in charge of monitoring these places is the Superintendence of Industry and Commerce. Recently, they set their sights on several well-known establishments in the country and issued a warning.

In case you fail to comply with any of the points, the fines for these places could be up to 2,000 wages current legal monthly minimums.
