Former Virginia Deputy Attorney General Monique Miles claimed Attorney General Jason Miyares and his office defamed her regarding the termination of Miles’ employment.

(CN) — Former Deputy Attorney General of Virginia Monique Miles filed a defamation lawsuit Wednesday in Richmond against Attorney General Jason Miyares and his staff. Miles claims in the complaint that Miyares and his staff have falsely labeled her termination as a resignation while Miles claims she was fired.

Miyares, who was elected last fall, allegedly fired Miles for her “controversial” opinions on the 2020 election and the Jan. 6 Capitol riot. 

Miyares’ Director of Communications Victoria LaCivita, a defendant in the case, told the New York Times that Miles and the office had parted ways due to a lack of transparency during the interview process. 

Miles claims in the complaint that the subject of the Jan. 6 riot along with the integrity of the 2020 presidential election did not come up during interviews. Miles served under a month as the deputy attorney general, a role she claims she reluctantly applied for after acquaintance and chief of staff for Miyares, Darrell Jordan, convinced her to apply. 

A private citizen in January of 2020, Miles used her Facebook to post in support of the “patriots” who stormed the Capitol. Miles herself had attended a Trump rally the same day as the protest that Miles claimed was “peaceful.” 

In a Facebook post on Jan. 6, Miles went as far as to include herself in the conversation with the other “patriots.” 

 “News Flash: Patriots have stormed the Capitol. No surprise. The deep state has awoken the sleeping giant. Patriots are not taking this lying down. We are awake, ready and will fight for our rights by any means necessary,” Miles stated in a Facebook post obtained by the Washington Post. 

Washington Post reporter Justin Jouvenal let Miles know shortly into her new position that he would be publishing an article about her Facebook posts. Miles claims she sought guidance from Chief Deputy Attorney General Charles “Chuck” Slemp III, a defendant in the case, on what to do after being asked for comment by Jouvenal on Feb. 10. 

Slemp requested Miles for an in-person meeting the following morning where Miles claims she brought screenshots of her post as she did not fear retaliation from her colleagues. Jordan and Slemp asked Miles to attend another meeting not long after where she claims they told her she was effectively terminated from her role and that she had the option to resign. 

In a message Miles sent to several of the defendants later that afternoon, Miles stated, “I have done nothing wrong.” and further defended her position claiming “a large majority of republicans and many independents” now hold her position on the 2020 election and the events of Jan. 6. 

Despite claiming she did not resign from the position, LaCivita issued a press statement that afternoon informing the press that Miles had resigned. After texting several defendants to try and clear the air on why the press was claiming she resigned, Jordan messaged her and stated, “You had surrendered your OAG identification and equipment. The understanding was that you resigned,” according to the complaint. 

Less than an hour later, Miles claimed she received a “suspicious” email from Slemp thanking her for resignation. After calling back and confirming to Slemp that she had not resigned, Miles was told the reason for her termination was not due to the Washington Post article but instead due to her lack of transparency and misrepresentation during the interview process. 

Miles claims that there was never a lack of transparency because Jordan had been her Facebook friend dating back four years, so he would have been aware of her post and opinions. The OAG reissued a press release that evening now claiming that Miles and the office had “parted ways” which she claims is defamatory. 

After asking the statement be redacted in a text chain to multiple defendants including Miyares, Miles was contacted individually by Jordan who claimed that the office was upset that she had spoken with a reporter at Newsmax and that they viewed her talking with the press as a threat. 

In the complaint Miles claims that her reputation and client base for her law firm have been damaged by the defendants. Miles is asking for a total of $1 million in damages.
